These Terms of Service govern your use of the services provided by Next Page Websites (ABN 94 358 811 957, "we", "us", "our"). By requesting a free preview, subscribing to a plan, or using our services, you agree to these terms. Please read them carefully.
1. About Us
Next Page Websites is an Australian web design and hosting business based at 311 Anketell St, Greenway ACT 2900. We provide website design, hosting, and management services to Australian small businesses.

2. Services
We offer website design, hosting, maintenance, and management services on a monthly subscription basis. The specific services included in each plan are described on our pricing page and may be updated from time to time.
Our free preview service is provided at no cost and with no obligation. We reserve the right to decline a preview request at our discretion.
3. Subscriptions & Payment
Subscription fees are charged monthly in advance. By subscribing, you authorise us to charge your nominated payment method on a recurring monthly basis until you cancel.
- All prices are in Australian dollars (AUD) and include GST where applicable.
- We reserve the right to change our pricing with 30 days' written notice.
- Payments are processed securely through our third-party payment provider. We do not store your full card details.
- If a payment fails, we will attempt to notify you. Access to services may be suspended if payment remains outstanding after 7 days.
4. Cancellation
You may cancel your subscription at any time by contacting us at contact@nextpagewebsites.com or by calling 0429 969 694. There are no lock-in contracts and no cancellation fees.
Cancellations take effect at the end of the current billing period. We do not offer pro-rata refunds for partial months unless required by Australian Consumer Law.
Upon cancellation, your website will be taken offline at the end of the billing period. If you wish to transfer your website files to another host, please request this before your cancellation date and we will assist where reasonably possible.
5. Your Content & Responsibilities
You are responsible for providing accurate information and content for your website. By providing content to us, you confirm that:
- You own or have the right to use all content you supply (text, images, logos, etc.)
- Your content does not infringe any third-party intellectual property rights
- Your content complies with all applicable Australian laws and regulations
- Your website will not be used for unlawful, misleading, or harmful purposes
We reserve the right to refuse to publish or to remove content that we reasonably believe is unlawful, defamatory, or in breach of these terms.
6. Intellectual Property
Upon receipt of full payment for services rendered, you own the content and copy on your website. The underlying website design, code, and template elements created by us remain our intellectual property unless explicitly agreed otherwise in writing.
You grant us a non-exclusive licence to display your website as part of our portfolio unless you request otherwise.
7. Hosting & Uptime
We aim to maintain high uptime for all hosted websites but do not guarantee 100% availability. Planned maintenance, third-party outages, and circumstances beyond our control may cause temporary downtime.
We perform regular backups but recommend you maintain your own copies of important content. We are not liable for data loss resulting from technical failures beyond our reasonable control.
8. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, our total liability to you for any claim arising from or relating to our services is limited to the total fees you paid us in the 3 months preceding the claim.
We are not liable for any indirect, consequential, or special loss, including lost revenue or lost business opportunity, arising from your use of our services.
Nothing in these terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality.
10. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of our services after changes take effect constitutes your acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of the ACT.
